Sales and Returns Policy – updated January 1st 2025

 

Fil Rouge Limited Return Policy For Taopatch Applicators and Approved Medical Clinics

 

This Sales and Returns Policy (“Policy”) applies to all products sold by Fil Rouge Limited (“Fil Rouge,” “we,” or “us”) to Taopatch Applicators and Approved Medical Clinics (“Customer” or “you”). By purchasing our products, you agree to be bound by the terms set forth below. Fil Rouge reserves the right to amend this Policy at any time without prior notice. Please review this Policy periodically.

1. Warranty & Guarantee

  • Manufacturing Defects:
    All products are guaranteed against manufacturing defects for twelve (12) months from the final customer purchase date.

  • Retail Guarantee:
    For retail sales, we offer a “30-day money back guarantee – no questions asked” provided the product is returned in its original condition. This guarantee does not apply to wholesale sales to Applicators and Approved Medical Clinics.

  • Wholesale Sales:
    No commercial returns are allowed unless expressly agreed to in writing by both parties.

2. Return Process for Manufacturing Defects

To be eligible for a return based on a manufacturing defect, the following conditions must be met. Returns that fail to comply will be rejected and returned to you at your cost:

  • Eligibility:
    The product must have been purchased directly from Fil Rouge Limited.

  • Submission:
    All return requests for a refund or replacement (at our sole discretion) must be submitted via email to info@filrouge.hk and include a detailed description of the defect.

  • Timeframe:
    The return process must be initiated and completed within five (5) days of receiving the product. You must provide the tracking number for the return shipment.

  • Documentation:
    A copy of the original invoice sent at the time of purchase must accompany the return.

Upon receipt of a properly submitted claim, Fil Rouge will assess the manufacturing defect and, at its sole discretion, may offer a free replacement or a refund.

3. Additional Return Requirements and Refund Policy

  • Applicator Foundation Course:
    The customer must have successfully attended our Applicator Foundation Course to be eligible for processing returns.

  • Return Processing:
    All return or replacement requests will be processed only after the returned item is received, inspected, and confirmed by our Fulfilment Team.

  • Reporting Damages:
    Any shipment received with visible damage must be reported to us within three (3) calendar days from the delivery date.

  • Complete Order Returns:
    To qualify for a refund, all items included in the original order must be returned. Partial returns, or returns with missing components (including, but not limited to, original manufacturer packing materials and retail packaging), will not be processed until all parts are received.

  • Shipping Costs:
    The customer is responsible for all return shipping expenses, while replacements will be shipped at our expense.

  • Refund Issuance:
    Refunds will be issued only after our warehouse has received, inspected, and processed the return. All refunds will be credited to your original method of payment.

4. Non-Refundable Items

Please note that certain items, including adhesive tapes and other Taopatch accessories, are non-refundable.

5. Limitation of Liability and Disclaimer

  • Return Decisions:
    All decisions regarding returns or refunds are made at our sole discretion after an internal assessment. Fil Rouge Limited reserves the right to refuse any return that does not comply fully with this Policy.

  • Limitation of Liability:
    To the fullest extent permitted by applicable law, Fil Rouge Limited shall not be liable for any incidental, consequential, or indirect damages arising from product returns or the use of our products.

  • No Waiver:
    The use of this Policy does not affect any consumer rights provided under applicable law. Fil Rouge Limited’s rights and remedies in relation to breaches of this Policy are cumulative and not exclusive.

7. Jurisdiction, Force Majeure, and Severability

  • Jurisdiction and Governing Law:
    This Policy and any disputes arising out of or relating to the use of our products and services shall be governed by and construed in accordance with the laws of Hong Kong SAR, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Hong Kong for any disputes arising under or in connection with this Policy.

  • Force Majeure:
    Fil Rouge Limited shall not be liable for any delay or failure in fulfilling its obligations under this Policy if such delay or failure is caused by events or circumstances beyond its reasonable control, including but not limited to, acts of God, natural disasters, war, terrorism, or governmental actions.

  • Severability:
    If any provision of this Policy is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect, and the invalid, illegal, or unenforceable provision shall be replaced by a valid, legal, and enforceable provision that most closely reflects the intended economic and legal effect.
